What it means
A lien (also called a builder's lien, mechanic's lien, or contractor's lien depending on the jurisdiction) is a legal claim a contractor can register against a property when the customer fails to pay for work performed on it. The lien attaches to the property title, meaning the customer cannot sell or refinance until the debt is settled. It's the strongest collection tool a contractor has, but every jurisdiction has strict deadlines for filing.
When you'd use a lien
When a customer has refused to pay despite reminders, the dispute is genuine, and the work was performed on the property in question. Liens are not for trade-account disputes or work disputes resolved by warranty. They're for unambiguous unpaid invoices on property-attached work.
Critical: jurisdiction-specific deadlines
Most jurisdictions require the lien to be filed within a set window after the work is completed (often 60 to 120 days). Missing the deadline kills your lien rights and you have to chase the debt as an ordinary creditor. Always check the deadline in your jurisdiction the moment a payment becomes overdue.
How to avoid needing a lien
Take deposits on every job over $1,000. Issue progress invoices on longer work so you're never carrying the whole project. Use written acceptance on every quote (signed copy or WhatsApp 'yes'). Stop work the moment a progress invoice is overdue. Liens are the last resort, not the first.
